Terms of use of the Xref-it.info site by registered institutions
You are required to read and agree to comply with the following in order for your subscription to be processed:
This page (together with the documents referred to on it) sets out the terms on which Registered Institutions may allow such number of their students and staff as are covered by their subscription (Permitted Users) to make use of our website www.crossref-it.info (the Site). Users will only be able to access the Site via computers within the Registered Institution’s network.
Information about us
The Site is operated as the Cross Reference Project by The Stapleford Centre (the Centre). The Centre is a private company limited by guarantee registered in England and Wales under company number 3371977 whose registered office is situated at The Stapleford Centre, The Old Lace Mill, Frederick Road, Stapleford, Nottingham NG9 8FN and is also registered as a charity. The Centre’s main trading address is at its registered office and its VAT number is 695 1265 12.
Accessing the site
Apart from the Home Page, access to the Site is restricted to registered individual users and individuals permitted to use the site by registered institutions. Users will only be able to access the Site via computers within the Registered Institution’s network. We reserve the right to withdraw or amend the service we provide on the Site without notice (see below). The Centre will not be liable if for any reason the Site is unavailable at any time or for any period.
Students and staff of the Registered Institution who are to have access to the Site will need a user identification code and password and may need other information as part of our security procedures. We will provide this information for the number of Permitted Users for whom access to the Site has been purchased by the Registered Institution direct to the Registered Institution. The Registered Institution must treat such information as confidential, and must not disclose it to any third party other than to Permitted Users. The Registered Institution is responsible for allocating such information to individual Permitted Users and ensuring that it is used in accordance with these terms.
Before having access to the Site, Permitted Users will be required to agree to observe the rules for Permitted Users set out in the Schedule to these terms. The Permitted User’s right to use the Site ends when the subscription expires or if they cease to be a student or member of staff of the Registered Institution. [If a Permitted User ceases to be a student or member of staff of the Institution, the Registered Institution may transfer that person’s user identification code and password to another student or member of staff provided that the new Permitted User will agree to observe the rules for Permitted Users set out in the Schedule.]
The Centre has the right to disable any user identification code or password, at any time, if, in our opinion, the user to whom that code and password have been allocated has failed to comply with any of the provisions of these terms of use.
The Registered Institution is responsible for:
Intellectual property rights
The Centre is the owner or the licensee of all intellectual property rights in the Site and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
Permitted Users may print off one copy, and may download extracts, of any individual page(s) from the Site for their personal reference only. The Institution may draw the attention of its students and staff to material posted on the Site. Neither the Registered Institution nor its Permitted Users may copy any part of the Site to any other server or location or pass copies of any materials on the Site to third parties and any such action will be treated as a breach of copyright.
The Registered Institution and its Permitted Users must not modify the paper or digital copies of any materials they have printed off or downloaded in any way, and they must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
The Registered Institution and its Permitted Users must not pass off material from the Site as their own work. Our status (and that of any identified contributors) as the authors of materials on the Site must always be acknowledged.
The Registered Institution and its Permitted Users must not incorporate any part of materials on the Site in any work created by them (other than by way of quotation of not more than 200 words with the source of the quotation duly acknowledged).
The Registered Institution and its Permitted Users must not use any part of the materials on the Site for commercial purposes.
If a Permitted User prints off, copies or downloads any part of the Site in breach of these terms of use, that Permitted User’s right to use the Site will cease immediately and he or she must, at our option, return or destroy any copies of the materials he or she has made.
Reliance on information posted
Whilst the Centre takes all reasonable endeavours to ensure the accuracy of the contents of the Site, the contents may reflect the individual views of contributors on matters that are open to different interpretations. The Centre therefore disclaims all liability and responsibility arising from any reliance placed on such materials by any visitor to the Site, or by anyone who may be informed of any of its contents.
The site changes regularly
The Centre aims to update the Site regularly, and may change the content at any time. If the need arises, we may suspend access to the Site, or close it indefinitely. We will use our reasonable endeavours to keep the Site up to date but any of the material on the Site may be out of date at any given time, and we are under no obligation to update such material.
Our liability
The material displayed on the Site is provided without any legal guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we and third parties connected to us hereby expressly exclude:
This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
Information about Permitted Users and their visits to the Site
The Centre holds information about Permitted Users to identify Permitted Users and record their use of the Site. By allowing Permitted Users to use the Site, you consent to such processing and you warrant that all data provided by you is accurate. We will not pass any personal data about Permitted Users to any third party other than to any person or company that may take over the operation of the Site from the Centre.
Viruses, hacking and other offences
Registered Institutions must not allow Permitted Users to misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. Permitted Users must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. Permitted Users must not attack the Site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, a Permitted User would commit a criminal offence under the Computer Misuse Act 1990. The Centre will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing the identity of the Permitted User to them. In the event of such a breach, that Permitted User’s right to use the Site will cease immediately.
The Centre will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to use of the Site by Permitted Users or to Permitted Users downloading of any material posted on it, or on any website linked to it.
Linking to the Site
Registered Institutions and Permitted Users may link to our home page, provided they do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but they must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
Registered Institutions and Permitted Users must not establish a link from any website that is not owned by them.
The Site must not be framed on any other site, nor may Registered Institutions and Permitted Users create a link to any part of the Site other than the home page. The Centre reserves the right to withdraw linking permission without notice. The website from which Registered Institutions or Permitted Users are linking must be one that is compatible with the ethos of the Centre and not unsuitable for viewing by persons under the age of 18.
If your Registered Institution wishes to make any use of material on the Site other than that set out above, please address your request to admin@xref-it.info
Links from the Site
Where the Site contains links to other sites and resources provided by third parties, these links are provided for information of Registered Institutions and Permitted Users only. The Centre has no control over the contents of those sites or resources, and accepts no responsibility for them or for any loss or damage that may arise from use of them.
Suspension and termination
We may, in our absolute discretion, terminate or suspend Permitted Users’ right to use the Site at any time, with or without notice, for any reason including, without prejudice to the generality of the foregoing, breach by Permitted Users of the terms of use, abuse of the Site, any wasting of staff time or any other activity that may interfere with or otherwise affect the use of the Site by others. If, in our complete discretion, we consider that the number of breaches of the terms of use of the Site by Permitted Users of a Registered Institution indicate that the Registered Institution is not adequately controlling the use of the Site by its Permitted Users, we may terminate or suspend the use of the Site by all the Registered Institution’s Permitted Users.
Jurisdiction and applicable law
The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Site, although we retain the right to bring proceedings for breach of these conditions in a Permitted User’s country of residence or any other relevant country. These terms of use are governed by English law.
Variations
The Centre may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we have made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on the Site.
